Terms and Conditions for Safaris Conducted by SMJ Safaris

Booking Agreement

By signing the booking agreement clients agrees fully to the terms and conditions of SMJ safaris.

Details of your safari and conditions of daily rates are stated on your booking agreement

Cancellation Policy

If a safari is canceled, cancellation fees will be due and payable according to the following:

  • If a safari is cancelled more than 210 days prior to arrival, 90% of the deposit will be refunded.
  • If a safari is canceled more than 180 days prior to arrival 50% of the deposit will be refunded.
  • If a safari is cancelled less than 120 days prior to arrival, no refund.

Depending on circumstances and safaris an additional agreement on the cancellation of a safari can be reached between SMJ Safaris and its clients if both parties agrees in writing to this agreement.


Liability

Although SMJ Safaris and it staff will try and ensure that our clients have an enjoyable trip or hunt we are working with nature and all its elements and hunting safaris is a dangerous affair. Therefore, SMJ Safaris, its agents and employees shall not be held liable for any damage, losses and expenses suffered by any client as a result of sickness, quarantine, weather conditions, war, strikes, riots or any other cause outside of our control.

SMJ Safaris, its agents and employees, accept no liability in respect of death, injury, loss or damage to person or property arising out of any act, omission or negligence. The client shall be deemed to have waived, renounced and abandoned any and all right or entitlement which the client may be entitled to under the provisions of the law of the Republic of Namibia for any loss or damage to person or property.

SMJ Safaris shall not be held liable for any loss or expense arising from the loss of property, cancellation or curtailment of the hunting safari however caused.

Client Responsibility

Clients are urged to make sure that they have adequate insurances for their up coming safaris for any liability or losses during the safaris. This will not be the responsibility of SMJ safaris in any form whatsoever.

Clients need to inform themselves of any vaccinations or medications needed for the safari.

Clients may not carry any unlawful articles or substances whilst in Namibia while a hunting safari or photographic safari is being conducted with SMJ Safaris. If any hunter or observer offends against the prohibitions set out herein, the hunting outfitter will be entitled to immediately exclude from the safari party the offender who will be responsible for his or her own repatriation and all costs thereof. SMJ Safaris will under no circumstances assist any such offender in any dealings or negotiations with any authority.

JURISDICTION

In all matters where it is or may be necessary to have recourse to the Court, the Courts of the Republic of Namibia shall have sole jurisdiction to the exclusion of the Courts of any other country and the law of the Republic of Namibia shall prevail.
